RESUMO: As parcerias entre as entidades do terceiro setor e o Estado foram ampliadas a partir da promulgação da Constituição de 1988. Desde então, a verba pública se tornou a principal fonte de recurso das instituições de caráter social. Ocorre que as parcerias entre o poder público e a sociedade civil tornaram-se escassas, comprometendo a sustentabilidade das instituições do terceiro setor. Neste sentido, através da presente pesquisa, pretende-se analisar as teorias e substratos jurídicos que viabilizam a captação de recursos provenientes de empresas pelas entidades sem fins lucrativos, a fim de verificar a perspectiva de ampliação dos incentivos legais às parcerias existentes entre os dois setores, de modo a promover a expansão das fontes de recursos das organizações não governamentais. A partir destes elementos, busca-se a resolução da seguinte problemática: Os incentivos legais às parcerias entre entidades sem fins lucrativos e empresas podem trazer benefícios à sociedade civil? Para tanto, serão analisadas as seguintes hipóteses: as parcerias entre o poder público e as entidades do terceiro setor geraram uma inversão de valores e interesses, resultando em casos de corrupção; o princípio constitucional da fraternidade, a legislação infraconstitucional e as principais vertentes teóricas sobre a função social da empresa podem servir de alicerce e estímulo para captação de recursos privados pelas entidades do terceiro setor; a legislação infraconstitucional brasileira pode ser ampliada e melhorada, no sentido de transferir uma parcela da responsabilidade do Estado com as instituições sem fins lucrativos para a seara empresarial, visando o alinhamento de interesses entre empresas e sociedade. A abordagem de pesquisa se dará na forma qualitativa, posto que as informações colhidas não são quantificáveis. Para a finalidade pretendida, será utilizado o método de pesquisa dedutivo, por meio do procedimento bibliográfico e documental, partindo dos aspectos gerais do relação entre o Direito Constitucional, Direito do Terceiro Setor e Direito Empresarial, a partir do estudo dos princípios da função social da empresa e da fraternidade, para uma análise econômico-jurídica das teorias e legislação que possam servir de base para o aperfeiçoamento da captação de recursos privados pelas entidades sem fins lucrativos.

ABSTRACT: The partnerships between third sector entities and the State were expanded after the promulgation of the 1988 Constitution. Since then, public funds have become the main source of funds for social institutions. It turns out that partnerships between public authorities and civil society have become scarce, compromising the sustainability of third sector institutions. In this sense, through this research, itens to analyze the theories and legal substrates that make it possible to raise funds from companies by non-profit entities, in order to verify the perspective of expanding the legal incentives to partnerships existing between the two sectors. , in order to promote the expansion of the sources of resources of non-governmental organizations. Based on these elements, we seek to solve the following problem: Can legal incentives for partnerships between non-profit entities and companies bring benefits to civil society? To this end, the following hypotheses will be analyzed: partnerships between public authorities and third sector entities have generated an inversion of values ​​and interests, resulting in cases of corruption; the constitutional principle of fraternity, infraconstitutional legislation and the main theoretical aspects of the company's social function can serve as a foundation and stimulus for the raising of private funds by third sector entities; Brazilian infraconstitutional legislation can be expanded and improved, in the sense of transferring part of the State's responsibility with nonprofit institutions to the business sector, aiming at the alignment of interests between companies and society. The research approach will be in a qualitative form, since the information collected is not quantifiable. For the intended purpose, the deductive research method will be used, through the bibliographic and documentary procedure, starting from the general aspects of the relationship between Constitutional Law, Third Sector Law and Business Law, from the study of the principles of the social function of company and fraternity, for an economic-legal analysis of theories and legislation that can serve as a basis for the improvement of private fundraising by non-profit organizations.
